Terms of Service

Effective Date: January 1, 2025 · Last Updated: October 17, 2026

These Terms of Service (“Terms”) govern your access to and use of the website, applications, and email automation platform (collectively, the “Service”) provided by Flowego (“Flowego,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

Flowego provides an email automation platform that enables users to:

  • Design and execute automated email workflows using a visual drag-and-drop builder.
  • Connect to external data sources, including Google Sheets, to dynamically populate email templates and trigger automations.
  • Create and manage email templates with a rich drag-and-drop editor.
  • Track email performance metrics including opens, clicks, bounces, and deliveries.
  • Manage SMTP configurations for sending emails through your own email infrastructure.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Google API Services Integration

The Service offers optional integrations with Google API Services, including Google Sheets, Google Drive, and Gmail. By connecting your Google account, you agree to the following:

  • Scope of Access: we request only the minimum permissions necessary — read-only access to Google Sheets and Drive for importing contact data, and send-only access to Gmail for delivering emails on your behalf.
  • Limited Use: data obtained through Google APIs is used exclusively to provide the features described in Section 2. We do not use this data for advertising, analytics unrelated to the Service, or any purpose not disclosed in our Privacy Policy.
  • Compliance: our use of Google API data complies with the Google API Services User Data Policy, including the Limited Use requirements.
  • Revocation: you may disconnect your Google account at any time from your dashboard settings or from your Google Account Permissions. Upon disconnection, we will cease accessing your Google data and delete stored tokens within 24 hours.

4. User Accounts

To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorized use of your account.

You may not share your account credentials with third parties or allow multiple individuals to use a single account unless your plan explicitly supports multiple users. We reserve the right to suspend or terminate accounts that we reasonably believe are being shared in violation of these Terms.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

  • Send unsolicited bulk emails (spam) or emails that violate the CAN-SPAM Act, GDPR, or any other applicable anti-spam or data protection legislation.
  • Use the Service to send emails containing malware, phishing attempts, or deceptive content.
  • Upload, transmit, or distribute content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or systems connected to the Service.
  • Use automated scripts, bots, or scrapers to access the Service in a manner that exceeds reasonable usage or places undue burden on our infrastructure.
  • Reverse engineer, decompile, or disassemble any portion of the Service.
  • Resell, sublicense, or redistribute the Service without our prior written consent, except as an agency under the Resellers and Agencies appendix.

We reserve the right to investigate and take appropriate action against any violations of this section, including suspending or terminating your account and reporting unlawful activity to law enforcement authorities.

6. Payment & Billing

Certain features of the Service require a paid subscription. By selecting a paid plan, you agree to the following:

  • Pricing: subscription fees are as displayed on our pricing page at the time of purchase. We reserve the right to change pricing upon 30 days' written notice.
  • Billing Cycle: subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan) unless cancelled before the next billing period.
  • Payment Method: you authorize us to charge your designated payment method for all applicable fees. Payments are processed through secure third-party payment processors.
  • Refunds: payments are non-refundable except where required by law. If you cancel a subscription, you will retain access to the paid features until the end of the current billing period.
  • Failed Payments: if a payment fails, we may suspend your access to paid features until the outstanding balance is resolved. We will attempt to notify you before suspension.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Flowego and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of the content you create using the Service (e.g., email templates, workflow configurations). By using the Service, you grant Flowego a limited, non-exclusive license to use your content solely for the purpose of providing and improving the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Flowego, its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
  • Any loss of profits, data, business opportunities, or goodwill, whether based on warranty, contract, tort, or any other legal theory.
  • Any damages resulting from unauthorized access to or alteration of your data or transmissions.
  • Any interruption, suspension, or termination of the Service, whether or not we were advised of the possibility of such damages.

In no event shall our total liability to you for all claims arising out of or relating to the Service exceed the amount you paid to Flowego during the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to:

  • Violation of these Terms or any applicable law.
  • Conduct that we determine, in our sole discretion, is harmful to other users, third parties, or the business interests of Flowego.
  • Non-payment of subscription fees.
  • Extended periods of account inactivity.

You may terminate your account at any time by contacting us or using the account settings in the Service. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Disclaimer of Warranties, and Governing Law) shall survive.

11. Indemnification

You agree to indemnify, defend, and hold harmless Flowego, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by posting the updated Terms on this page and updating the “Last Updated” date. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must discontinue your use of the Service.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Appendix: Resellers and Agencies

This appendix applies to organizations that join our agency program to offer the Service to their own clients under their own brand (an “Agency”). It supplements the rest of these Terms; where the two conflict, this appendix prevails for the agency program.

  • Right to resell: while its agency subscription is active, we grant the Agency a non-exclusive, non-transferable right to provide the Service to its clients under the Agency's own name and brand. The right ends when the subscription ends and is paused while the Agency is suspended.
  • Relationship with clients: the Agency's clients contract with the Agency. The Agency sets its own prices, collects its clients' payments through its own payment account, and provides its own terms and privacy notice to its clients.
  • Responsibility: the Agency is responsible for its clients' use of the Service and ensures that they comply with Section 5 (Acceptable Use). We may suspend a client account that violates these Terms and will inform the Agency.
  • Personal data: the Agency is responsible for informing its clients and for the lawful basis of the processing carried out for them through the Service. We process that data only to provide the Service, as described in our Privacy Policy.
  • Brand: the Agency may show its own name, logo, colors, domains and sending servers to its clients. Our name may still appear in Google's consent screen when a client connects a Google account, in the platform address used until the Agency connects its own domain, and in the platform sender used until the Agency configures its own email server.
  • Limits: the agency subscription includes a maximum number of clients and a monthly email quota shared by all clients, both shown in the agency panel. The modules available to clients are those included in the agency subscription.
  • Support: the Agency provides first-line support to its clients. We provide technical support to the Agency, including requests the Agency forwards to us from its clients.
  • Non-payment: if the agency subscription is not renewed, after a grace period the Agency's account and its clients' accounts may be suspended. Suspension does not by itself delete any data.
